Appeal Board on Closure Orders (Immediate Health Hazard)
The Appeal Board on Closure Orders (Immediate Health Hazard) ("ABCO(IHH)") is a statutory body set up under section 128D of the Public Health and Municipal Services Ordinance (Cap. 132) to consider appeals against the decision of Director of Food and Environmental Hygiene ("DFEH") to make a closure order or his refusal to rescind a closure order under section 128C of Cap. 132.
A. Function
- The ABCO(IHH) is a statutory appeal body to hear and determine appeals by appellants against decisions made by DFEH under section 128C(1) or section 128C(7) of the Public Health and Municipal Services Ordinance (Cap. 132).
- A person who is aggrieved by an order made under section 128C(1) or dissatisfied with the decision of DFEH made under 128C(7) of the Public Health and Municipal Services Ordinance (Cap. 132) may appeal to ABCO(IHH) within 7 days after the day on which the order was made or the decision was served on him/her. If he/she is again not satisfied with the decision of ABCO(IHH), he/she may lodge further appeal to the Court of First Instance within 14 days after receiving the ABCO(IHH) decision.

- For the purposes of hearing an appeal, the board is to consist of the Chairman or a Deputy-Chairman as the person presiding and 2 other members.
C. Submission of "Notice of Appeal"
The Notice
of Appeal must be completed in ink and delivered
by hand within the prescribed period to the Secretariat
of ABCO(IHH) at Room 2010, 20/F, Murray Building,
Garden Road, Central, Hong Kong.
