Licensing Appeals Board

The Licensing Appeals Board ("LIAB") is a statutory body set up under section 125A of the Public Health and Municipal Services Ordinance (Cap. 132) to consider appeals against decisions made by the relevant licensing authorities (the Food and Environmental Hygiene Department, the Leisure and Cultural Services Department and the Department of Health) in relation to licensing matters under Cap. 132.

A. Function

  • The Licensing Appeals Board is the first tier appeal body to hear and determine appeals by appellants against decisions made by the licensing authorities under section 125(1)(b) of the Public Health and Municipal Services Ordinance (Cap. 132.)
  • A person who is dissatisfied with the decision of the licensing authority may appeal to LIAB within 14 days after the service on him of the decision. If he is again not satisfied with the decision of LIAB, he may lodge further appeal to the Municipal Services Appeals Board within 14 days after receiving the LIAB decision.

  • For the purpose of hearing an appeal, the board is to consist of the Chairman or Vice-Chairman as the person presiding and 4 other members.

C. Electronic Submission of "Notice of Appeal"

Any person who wishes to submit his/her notice of appeal to the Secretary, Licensing Appeals Board in the manner and format as provided under the Electronic Transaction Ordinance should read the explanatory notes before sending it to the Secretary.
